H.B. 617

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed House Bill 617.

This bill requires the Department of Natural Resources to design a consolidated
permitting mechanism for construction and major repairs of piers and bulkheads in the
Chesapeake Bay Critical Area and adjacent waters and wetlands.

Senate Bill 566, which was passed by the General Assembly and will be signed by me on
May 25, 1995, accomplishes the same purpose. Therefore, it is not necessary for me to
sign House Bill 617.

AN ACT concerning

Critical AreaConstruction of Piers and Bulkheads - Consolidated Permit Process

State and Local Regulation

FOR the purpose of requiring the Department of Natural Resources, in consultation with
c
ertain agencies, to design and implement a consolidated permitting mechanism for
construction and major repair of piers and bulkheads in the Chesapeake Bay
Critical Area and adjacent waters and wetlands; establishing c
ertain requirements
for th
e permitting mechanism,including a consolidated application process
delegated from State and federal agencies, and administration at the local level;
requiring review and approval mechanism
s to be uniform to the extent possible;
requiring the Department to study and r
eport by a certain date to the Governor and
the General Assembly on the implementation of development of the consolidated
permitting m
echanism under this Act; providing for the effective date of this Act;
and generally relating to pier and bulkhead construction and repair in the
Ch
esapeake Bay Critical Area and adjacent waters and wetlands and the Chesapeake
Bay Critical Area Commission jointly to review existing regulations applicable to the
construction of piers and bulkheads in certain areas of the State; requiring the
Department and the Commission to develop a certain procedure to avoid a certain
regulatory duplication by the State and local jurisdictions; providing that a certain
procedure recognize a certain State and local jurisdictional authority for certain
purposes; and generally relating to State and local regulation of piers and bulkheads.

BY repealing and reenacting, without amendments,

Section 9-101(a) and (d)
Annotated Code of Maryland
(1990 Replacement Volume and 1994 Supplement)
