VETOES

(E) THE STATE BOARD OF EDUCATION SHALL DEVELOP REGULATIONS TO
ENSURE THAT THE ARREST INFORMATION:
.

(1) IS USED ONLY FOR THE PURPOSE OF IMPROVING THE ABILITY OF
THE SCHOOL THAT THE CHILD ATTENDS TO ASSIST THE CHILD AND TO PROTECT
THE SAFETY OF OTHERS; AND

(2) MAY NOT BE USED AS THE SOLE BASIS FOR SUSPENSION OR
EXPULSION OF THE CHILD.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland

ead as follows:

ArticleCourts and Judicial Proceedings

3-835.1.

(A) (1) IN THIS SECTION THE FOLLOWING TERMS HAVE THE MEANINGS
INDICATED.

(2) "CITATION" MEANS A CIVIL CITATION ISSUED BY A LAW
ENFORCEMENT OFFICER WHICH ALLEGES A MISDEMEANOR VIOLATION.

(3) "COMMUNITY SERVICE COORDINATOR" MEANS THE PERSON
ASSIGNED BY THE DEPARTMENT TO RECEIVE CITATIONS, COORDINATE
COMMUNITY SERVICE, MONITOR COMPLIANCE, AND FILE COMPLAINTS WITH AN
INTAKE OFFICER.

(4) "DEPARTMENT" MEANS THE DEPARTMENT OF JUVENILE JUSTICE.

(5) "PILOT PROGRAM" MEANS THE MISDEMEANOR CIVIL CITATION
PILOT PROGRAM.

(6) "SECRETARY" MEANS THE SECRETARY OF JUVENILE JUSTICE.

(B) (1) THERE SHALL BE A MISDEMEANOR CIVIL CITATION PILOT
PROGRAM IN ALLEGANY, PRINCE GEORGE'S, SOMERSET, AND WICOMICO COUNTIES.

(2) EXCEPT AS OTHERWISE INDICATED, THE PROVISIONS OF THIS
SECTION SHALL APPLY ONLY TO THE PILOT PROGRAM.

(3) SUBJECT TO CONDITIONS ESTABLISHED BY THE SECRETARY, A
JUVENILE WHO MOVES OUT OF A COUNTY PARTICIPATING IN THE PILOT PROGRAM
SHALL REMAIN SUBJECT TO THE REQUIREMENTS OF THE PILOT PROGRAM.

(4) LAW ENFORCEMENT AGENCIES IN JURISDICTIONS WHERE THE
PILOT PROGRAM IS OPERATING SHALL COOPERATE WITH THE DEPARTMENT AND
COMPLY WITH ANY REGULATIONS ISSUED BY THE DEPARTMENT TO IMPLEMENT
THIS SECTION.

(C) (1) IF A LAW ENFORCEMENT OFFICER AUTHORIZED TO MAKE ARRESTS
HAS. PROBABLE CAUSE TO BELIEVE THAT A CHILD HAS COMMITTED AN ACT WHICH,
IF COMMITTED BY AN ADULT WOULD BE A MISDEMEANOR, THE OFFICER MAY:
