S.B. 810

(b)     "Dislocated worker" means an individual worker or an individual who is part
of a substantial group of eligible individuals who:

(1)     has been terminated or laid off or has received a notice of termination or
lay-off from employment, is eligible for, receiving unemployment, or has exhausted the
individual's entitlement to unemployment compensation, and is unlikely to return to the
individual's previous industry or occupation;

(2)     has been terminated, or has received a notice of termination of
employment, as a result of any permanent closure of a plant or facility; or

(3)     is long-term unemployed and has limited opportunities for employment
or reemployment in the same or a similar occupation in the area in which the individual
resides, including any older individual who may have substantial barriers to employment
by reason of age.

(c)     "Economically disadvantaged individual" means an individual who:

(1)     receives, or is a member of a family which receives, cash welfare
payments under a federal, State, or local welfare program;

(2)     has, or is a member of a family which has, received a total family income
for the 6-month period prior to application for the program involved (exclusive of
unemployment compensation, child support payments, and welfare payments) which, in
relation to family size, was not in excess of the higher of the poverty level determined in
accordance with criteria established by the United States Office of Management and
Budget, or 70 percent of the lower living standard income level;

(3)     is receiving food stamps pursuant to the Food Stamp Act of 1977;

(4)     is a foster child on behalf of whom State or local government payments
are made; or

(5)     in cases permitted by regulations of the Secretary, is an adult
handicapped individual whose own income meets the requirements of paragraph (1) or
(2) of this subsection, but who is a member of a family whose income does not meet such
requirements.

(d)     "Federal act" means the federal Job Training Partnership Act.

(e)     "Governor's plan" means the Governor's coordination and special services
plan as provided in Section 121 of the federal act.

(f)      "Handicapped individual" means any individual who has a physical or mental
disability which for the individual constitutes or results in a substantial handicap to
employment.

(g)     "Job training plan" means the training plan required for each service delivery
area as provided in §§ 103 and 104 of the federal act and any final plan or modification as
provided in § 105 of the federal act.
