S.B. 810

(e) The Board of Public Works is authorized to empower the State Treasurer to
advance funds to the Administration to be reimbursed at a later date from the proceeds
of bond sales.

[6-305.] 6-405.

The Administration may exercise all the powers necessary for carrying out the
provisions of this subtitle, including the power to:

(1)     Adopt rules and regulations, policies, and procedures for the regulation
of its affairs, the conduct of its business, and to otherwise implement the provisions of this
subtitle;

(2)     Establish and appoint advisory committees that it considers appropriate
to assist in carrying out the provisions of this subtitle;

(3)     Adopt an official seal;

(4)     Sue and be sued in its own name; provided, that the Secretary and any
other person executing the bonds of the Administration is not personally liable or
accountable by reason of their issuance;

(5)     Make and enter into contracts or other agreements with any person for
any purpose that the Administration determines is necessary or incidental to the
performance of its duties and to the execution of the purposes of this subtitle, including
contracts relating to the employment or retention of consulting and other engineers,
financial advisors, bond counsel, accountants and any other employees, advisors and
agents;

(6)     Make application for, receive and accept from any person, a grant, loan,
loan guarantee, or any other form of financial assistance relating to the activities of the
Administration;

(7)     Receive and accept aid or a contribution from any source, whether in the
form of money or property, labor, or any other thing of value;

(8)     Participate in any price support program, loan program or any other
program of the federal or of this State government or local government of this State that
relates to energy production or conservation;

(9)     Provide financial assistance to any person for:
(i) An energy project or projects;

(ii) Any pre-investment activity, including a feasibility study;

(iii) Technical and management advice and assistance as necessary
under the circumstances;

(iv) A demonstration energy project that is of high priority and broad
public application; or
