S.B. 641

(1)       [plan,] PLAN, select, construct, improve, and maintain the State
highway system; AND

(2)      BY FISCAL YEAR 2000, DESIGNATE JULY 1, 1997, IN COORDINATION
WITH LOCAL GOVERNMENTS, DRAFT A PLAN FOR A BICYCLE PRIORITY ROUTE
SYSTEM THAT PROVIDES A VIABLE NETWORK FOR BICYCLE TRANSPORTATION
THROUGHOUT THE STATE.

8-601.1.

(A)     IN THIS SECTION, "BICYCLE WAY" HAS THE MEANING STATED IN §
21-101(L) OF THIS ARTICLE.

(B)     (1) IN CONSTRUCTION, RECONSTRUCTION, OR REPAIR OF STATE
HIGHWAYS, THE ADMINISTRATION SHALL ENSURE THAT THE PROJECT DOES NOT
RESULT IN A NET LOSS OF ANY BICYCLE WAY.

(2) IF THE ADMINISTRATION REASONABLY DETERMINES THAT A
HIGHWAY PROJECT REQUIRES THE ELIMINATION OF AN EXISTING BICYCLE WAY,
THE ADMINISTRATION SHALL CONSTRUCT A NEW, SAFE, AND REASONABLE
ALTERNATIVE ROUTE FOR BICYCLE TRAVEL.

(A) THE ADMINISTRATION MAY NOT CONSTRUCT ANY PROJECT THAT WILL
RESULT IN THE SEVERANCE OR DESTRUCTION OF AN EXISTING MAJOR ROUTE FOR
BICYCLE TRANSPORTATION TRAFFIC, UNLESS THE PROJECT PROVIDES FOR
CONSTRUCTION OF A REASONABLE ALTERNATIVE ROUTE OR SUCH A ROUTE
ALREADY EXISTS.

(C) (B) THE ADMINISTRATION SHALL ADOPT REGULATIONS NECESSARY
DEVELOP GUIDELINES JOINTLY WITH LOCAL GOVERNMENTS TO CARRY OUT THE
PROVISIONS OF THIS SECTION.

8-611.

(b) (1) In calendar year 1979 and in each second year following, the
Administration, following an assessment of the highway conditions and transportation
needs of this State, shall prepare those proposed modifications to the highway needs
inventory that it considers necessary.

(2) BY FISCAL YEAR JULY 1, 1997, THE ADMINISTRATION, IN
COOPERATION WITH LOCAL GOVERNMENTS, SHALL INVENTORY STATE AND LOCAL
FACILITIES NEAR SCHOOLS, PARKS DESIGNATED BY THE DEPARTMENT OR LOCAL
GOVERNMENT AS "MAJOR" PARKS,
RAIL STOPS, LIGHT RAIL STOPS, AND SUBWAY
STATIONS, COMMERCIAL CENTERS DESIGNATED BY THE DEPARTMENT OR LOCAL
GOVERNMENT AS "MAJOR" COMMERCIAL CENTERS, AND EMPLOYMENT CENTERS
DESIGNATED BY THE DEPARTMENT OR LOCAL GOVERNMENT AS "MAJOR"
EMPLOYMENT CENTERS
TO DETERMINE WHAT IMPROVEMENTS ARE NEEDED TO
ACCOMMODATE IN A SAFE AND EFFECTIVE MANNER ACCESS BY: PEDESTRIANS AND
BICYCLES WITHIN A REASONABLE DISTANCE FOR WALKING AND BICYCLING.

(I) PEDESTRIANS WITHIN 1 MILE OF THE TRIP DESTINATION; AND
