House Bill 1054, which was passed by the General Assembly and signed by me on May 18,
1995, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 532.

AN ACT concerning

Community Colleges - Funding of English for Speakers of Other Languages Programs

FOR the purpose of funding programs for students who are enrolled in English for
Speakers of Other Languages programs and enrolled in community colleges in the
State; providing funding for students who are enrolled in English for Speakers of
Other Languages programs at Baltimore City Community College; setting certain
criteria to qualify for the grant; specifying a certain limitation on the total amount of
grants provided under this Act; providing for the repayment of any excess funds to
the General Fund of the State; and generally relating to funding English for
Speakers of Other Languages programs.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

16-403.

(D) (1) (I) BEGINNING IN FISCAL YEAR 1996, A GRANT IN THE AMOUNT
PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION SHALL BE DISTRIBUTED TO
EACH BOARD IN ORDER TO PROVIDE INSTRUCTION AND SERVICES TO STUDENTS
ENROLLED IN AN ENGLISH FOR SPEAKERS OF OTHER LANGUAGES ("ESOL")
PROGRAM. TO QUALIFY FOR THE GRANT, STUDENTS SHOULD MEET THE
FOLLOWING CRITERIA: THE STUDENT WAS BORN OUTSIDE OF THE UNITED STATES
OR WHOSE NATIVE LANGUAGE IS NOT ENGLISH; THE STUDENT COMES FROM AN
ENVIRONMENT WHERE A LANGUAGE OTHER THAN ENGLISH IS DOMINANT; OR THE
STUDENT IS AN AMERICAN INDIAN OR ALASKAN NATIVE AND COMES FROM AN
ENVIRONMENT WHERE A LANGUAGE OTHER THAN ENGLISH HAD A SIGNIFICANT
IMPACT ON HIS/HER LEVEL OF ENGLISH LANGUAGE PROFICIENCY.

(II) TO QUALIFY FOR A GRANT UNDER THIS SUBSECTION, EACH
PARTICIPANT IN THE PROGRAM SHALL BE A STUDENT:
