S.B. 500

(a)     A personal representative may resign bis THE PERSONAL
REPRESENTATIVE'S position by filing a written statement of resignation with the register
after be THE PERSONAL REPRESENTATIVE has given at least [15] 20 days written
notice to all interested persons of bis THE PERSONAL REPRESENTATIVE'S intention to
resign.

(b)     If no one applies for the appointment of a successor personal representative
or special administrator, and an appointment is not made within the [15-day] 20-DAY
period, the resigning personal representative may apply to the court for the appointment
of his THE PERSONAL REPRESENTATIVE'S successor.

(c)     The resignation is effective upon the appointment of a successor, and the
resigning personal representative shall immediately account for and deliver the property
belonging to the estate to the successor or special administrator.

(d)     The resignation of a copersonal representative is effective upon the giving of
notice and the filing of the statement of resignation as provided in this section.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 500.

This amended bill allows a surviving tenant by the entireties to disclaim, without the
written consent of the deceased spouse, any property devolving to the surviving tenant by
right of survivorship. Further, it clarifies that a joint tenant with property devolving to the
joint tenant is a surviving joint tenant, and it clarifies that within nine months after the
death of a tenant the surviving tenant must file the disclaimer.

House Bill 577, which was passed by the General Assembly and signed by me on May 18,
1995, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 500.
