Ch. 6                                       1995 LAWS OF MARYLAND

WHEREAS, The use of replacement players is likely to cost the local television and
radio busin
esses significant losses in advertising and sponsorship revenues; and

WHEREAS, The use of replacement players may result in a long-term negative
impact on attendance at major league professional baseball games played at the stadium;
and

WHEREAS, The use of replacement players and the resulting decline in
attendance at the stadium would cause the economy in Baltimore losses of well over $100
million in 1995; and

WHEREAS, The stadium is critical to the economies of the Baltimore region and of
the State as a whole; and

WHEREAS, The State has a compelling interest in protecting its substantial
investment in the stadium; now, therefore,

SECTION 1. BE IT ENACTED. BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Financial Institutions

13-723.

(A)     IN THIS SECTION, "CAMDEN YARDS" MEANS APPROXIMATELY 85 ACRES IN
BALTIMORE CITY IN THE AREA BOUNDED BY CAMDEN STREET ON THE NORTH,
RUSSELL STREET ON THE WEST, OSTEND STREET ON THE SOUTH, AND HOWARD
STREET AND INTERSTATE 395 ON THE EAST.

(B)     NOTWITHSTANDING ANY OTHER PROVISION OF THIS SUBTITLE, THE
AUTHORITY SHALL PROHIBIT A MAJOR LEAGUE PROFESSIONAL BASEBALL TEAM
MAY NOT PLAY FROM PLAYING BASEBALL IN A STADIUM IN CAMDEN YARDS IF
FEWER THAN 75% OF THE TEAM'S BASEBALL PLAYERS WERE BASEBALL PLAYERS ON
A MAJOR LEAGUE PROFESSIONAL BASEBALL TEAM IN THE PRECEDING YEAR
IF
FEWER THAN 75% OF THE PLAYERS ON THE TEAM'S CURRENT 40-PLAYER MAJOR
LEAGUE ROSTER WERE ON THE 40-PLAYER MAJOR LEAGUE ROSTER OF A
PROFESSIONAL TEAM IN MAJOR LEAGUE BASEBALL AT ANY TIME IN THE
PRECEDING CALENDAR YEAR.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety, has
been passed by a yea and nay vote supported by three-fifths of all of the members elected
to each of the two Houses of the General Assembly, and shall take effect from the date it
is enacted. At the end of March 31, 1996, with no further action required by the General
Assembly, this Act shall be abrogated and of no further force and effect.
