Ch. 631                                    1995 LAWS OF MARYLAND

(8)     Any strip or deep mining of coal regulated under Title 7, Subtitle 5 or
5A of this article and any noncoal surface mining regulated under Title 7, Subtitle 6A of

. this article;

(9)     Any activity required for the purpose of constructing a dwelling house
intended for the use of the owner, or a child or grandchild of the owner, if the activity
does not result in the cutting, clearing, or grading of more than 40,000 square feet of
forest; [and]

(10) A county that has and maintains [200,000] 100,000 acres or more of its
land area in forest cover; AND

(11) ANY AREA THAT IS?

(I) WITHIN OR ADJACENT TO AN AIRPORT; AND

(II) SUBJECT TO THE APPLICATION OF 49 C.F.R. PART 77 RELATING
TO "OBJECTS AFFECTING NAVIGABLE AIRSPACE";

(12) ANY LAND THAT IS ZONED INDUSTRIAL; AND

(13) ANY PARCEL OF PROPERTY PROPOSED FOR DEVELOPMENT THAT IS
ZONED FOR INDUSTRIAL OR MANUFACTURING LAND USE.

(11) THE CUTTING OR CLEARING OF TREES TO COMPLY WITH THE
REQUIREMENTS OF 14 C.F.R. § 77.25 RELATING TO OBJECTS AFFECTING NAVIGABLE
AIRSPACE, PROVIDED THAT THE FEDERAL AVIATION ADMINISTRATION HAS
DETERMINED THAT THE TREES ARE A HAZARD TO AVIATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning

Counties and Municipal Corporations - Historic Area Zoning - Historic District

Commissions

FOR the purpose of altering the types of places for which and the basis on which certain
counties and any municipal corporation may regulate for purposes of historic
preservation under certain circumstances; altering certain powers of certain local
historic district commissions regarding easements, application review and approval,
and the transaction of business; permitting certain work to be conducted on historic
sites, structures, or districts without commission approval under certain
circumstances; providing for enforcement of certain violations of this Act; making
stylistic changes; repealing certain obsolete provisions concerning overhead utility
