OTHER ACTION TAKEN BY THE DEPARTMENT, IN ITS OWN NAME OR IN THE NAME
OF THE MARYLAND WORKFORCE TRAINING FINANCE FUND, PURSUANT TO THIS
SUBTITLE SHALL BE CONCLUSIVE OF THE MATTERS DETERMINED THEREIN.
SECTION 2. AND BE IT FURTHER UNACTED, That this Act shall take effect
October 1, 1995.
SECTION 2. AND BE IT FURTHER ENACTED, That § 3-704(a)(3) §
3-703(a)(3) of Article 83A of the Annotated Code, as added by this Act, shall take effect
October 1, 1996.
SECTION 3. AND BE IT FURTHER ENACTED, That, except as provided in
Section 2 above, this Act shall take effect October 1, 1995.

AN ACT concerning
Commercial Law - Contracts - Copyright Royalties
FOR the purpose of requiring certain copyright owners and performing rights societies to
provide certain information to the proprietors of certain retail establishments
before entering into contracts with them for the payment of royalties; prohibiting a
copyright owner or performing rights society from engaging in certain practices in
connection with the collection of royalties when dealing or negotiating with proprietors
and when charging or collecting royalties; requiring certain agents or employees of
performing rights societies to make certain disclosures to proprietors when discussing
certain royalties contracts, the use of copyrighted works by the proprietor, and the
. payment of certain royalties or fees; prohibiting a copyright owner or performing
rights society from charging or collecting a royalty which is unreasonable in
comparison to the royalties for similar licenses in a certain area; requiring certain
contracts for the payment of royalties to include certain information and to be in a
certain form; requiring a performing rights society to offer a proprietor a contract of a
certain term but allowing the performing rights society and the proprietor to agree to a
contract of another term; providing for the application of this Act; providing for
certain penalties remedies; providing for certain legal actions; defining certain
terms; providing that this subtitle is in addition to certain other laws and that it may not
be construed to deny, abrogate, or impair those laws; and generally relating to
copyright royalties.
