1995 LAWS OF MARYLAND

Underground Storage Tank Upgrade and Replacement Fund; prohibiting the use of
certain funds after a certain date from the Oil Contaminated Site Environm
ental
Cl
eanup Fund; requiring the Department of the Environment in conjunction with
certain entities to study and make certain r
ecommendations on certain oil cleanup
issu
es by a certain date; providing certain funding for the Oil Contaminated Site
Environmental Cleanup Fund for certain fiscal years; making stylistic changes;
providing for the effective date of this Act; and generally relating to underground
storage tank cleanup activities.

BY repealing and reenacting, with amendments,

Annotated Code of Maryland
(1993 Replacement Volume and 1994 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Environment

4-606.

(a) To be eligible for a loan under this subtitle, an applicant shall:

(1)     Be in substantial compliance with all State and federal laws and
regulations governing the installation, operation, and use of underground storage tanks;
and

(2)    Submit a final application to the Department on or before [December
31, 1995] JUNE 30, 1998.

4-607.

(a)     Unless further action is taken by the General Assembly, no fee may be
[collected] IMPOSED or any loan made under the provisions of or for the purposes of
this subtitle, or in accordance with regulations adopted under this subtitle, after [June
30, 1996] DECEMBER 31, 1998.

(b)     On or after [July 1, 1996] DECEMBER 31, 1998 JANUARY 1, 1999, any funds
remaining in the Underground Storage Tank Upgrade and Replacement Fund shall be
credited to the Maryland Oil Disaster Containment, Clean-Up and Contingency Fund to
be used by the Department for cases in which a responsible party cannot be located or the
responsible party does not have sufficient assets to take adequate remedial action for:

(1)     The clean-up and removal of an underground storage tank; or

(2)     The clean-up of a petroleum release.
