(2) PARAGRAPH (1) OF THIS SUBSECTION DOES NOT APPLY TO A
PERSON WHO IS CERTIFIED BY THE BOARD AS A CERTIFIED PROFESSIONAL
COUNSELOR OR A CERTIFIED PROFESSIONAL COUNSELOR MARRIAGE AND FAMILY
THERAPIST.

(B) Except as otherwise provided in this title, unless a person is certified to
practic
e professional counseling, the person may not:

(1) Represent to the public by title, by description of services, methods, or
procedures, or otherwis
e, that the person is certified by the Board to provide professional
counseling servic
es in this State;

(2) Use any title, abbreviation, sign, card, or other representation that the
person is a certified prof
essional counselor or licensed professional counselor marriage
and family therapist; or

(3) Use the title "C.P.C." or "C.P.C. M.F.T.", the words "certified
professional couns
elor" or "licensed professional counselor marriage and family
therapist", or the words "certifi
ed counselor" or "licensed marriage and family therapist"
with the intent to represent that the person practices professional counseling or marriage
and family therapy.

17-402.

(a) Any person who violates any provision of § 17-401 of this subtitle is guilty of
a misd
emeanor and on conviction is subject to a fine not exceeding $500 or imprisonment
not exceeding 6 months or both.

(b) ANY PERSON WHO IS CONVICTED UNDER SUBSECTION (A) OF THIS
SECTION AND COMMITS A SECOND OR SUBSEQUENT VIOLATION OF ANY PROVISION
OF
§ 17-101 OF THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND ON CONVICTION
IS SUBJECT TO A FINE NOT EXCEEDING $2,500 OR IMPRISONMENT NOT EXCEEDING 1
YEAR OR BOTH.

(C) Each violation of this section is a separate offense.

18-101.

(e) (1) "Practice psychology" means to provide to any person:

(i) Any service FOR COMPENSATION involving the application of
psychological principles, psychological methods, or psychological procedures for
understanding, predicting, or influencing behavior, including the principles that relate to
learning, perception, motivation, emotions, organizational relationships, and
interpersonal relationships;                                                                                         

(ii) Any service FOR COMPENSATION involving the application of
psychological methods or psychological procedures for interviewing, counseling,
psychotherapy, behavior modification, or hypnosis; or
