3. A MEMBER OF THE CASINO NIGHT COMMISSION MAY
NOT:
A. RECEIVE A FINANCIAL BENEFIT FROM, OR BE AN
OFFICIAL OR MEMBER OF, A PERSON THAT IS SUBJECT TO REGULATION BY THE
CASINO NIGHT COMMISSION; OR
B. HAVE AN IMMEDIATE FAMILY MEMBER WHO RECEIVES A
FINANCIAL BENEFIT FROM, OR WHO IS AN OFFICIAL OR MEMBER OF, A PERSON
THAT IS SUBJECT TO REGULATION BY THE CASINO NIGHT COMMISSION.
4. THE TERM OF A MEMBER IS 3 YEARS.
5. THE TERMS OF MEMBERS ARE STAGGERED AS REQUIRES
BY THE TERMS IN EFFECT FOR THE INITIAL MEMBERS OF THE CASINO NIGHT
COMMISSION.
6. A MEMBER MAY NOT SERVE CONSECUTIVE 3 YEAR
TERMS.
7. AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED.
8. A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A SUCCESSOR IS
APPOINTED.
9. A MEMBER OF THE CASINO NIGHT COMMISSION:
A. MAY NOT RECEIVE COMPENSATION; BUT
B. IS ENTITLED TO REIMBURSEMENT FOR EXPENSES AS
PROVIDED IN THE BUDGET OF THE CASINO NIGHT COMMISSION.
(IV) A CASINO NIGHT COMMISSION ESTABLISHED UNDER
SUBPARAGRAPH (II) OF THIS PARAGRAPH EACH YEAR SHALL SUBMIT TO THE
MEMBERS OF THE HOUSE OF DELEGATES IN THE PRINCE GEORGE'S COUNTY
DELEGATION A REPORT CONCERNING THE AMOUNT OF GRATUITIES RECEIVED IN
THE PREVIOUS YEAR TO INDIVIDUALS WHO ASSIST IN CASINO NIGHTS IN PRINCE
GEORGE'S COUNTY.
(6) (5) (I) THE NUMBER OF PERMITS ISSUED FOR THE OPERATION
OF CASINO NIGHTS MAY NOT EXCEED 19 21 AT ANY TIME.
(II) THE COUNTY IN ITS DISCRETION MAY ISSUE FEWER THAN 19 21
PERMITS FOR THE OPERATION OF CASINO NIGHTS.
(7) (6) (I) AN APPLICATION SUBMITTED FOR ISSUANCE OR
RENEWAL OF A CASINO NIGHT PERMIT MAY NOT BE CONSIDERED PRIMA FACIE
EVIDENCE THAT THE APPLICANT IS ENTITLED TO THE PERMIT.
