[(2)] (B) If the person is a business entity and not a natural person, each
officer and partner of the business entity who knowingly authorized or participated in the
violation is guilty of a misdemeanor[,] and upon conviction[,] is subject to the same
penalties as the business entity.

[(b)] (C) The provisions of this [subtitle] PART V shall be enforced by the
State's Attorney for Montgomery County.

(a)     The County Council has no legal duty to verify the accuracy of any disclosure
statement filed under this [subtitle] PART V.

(b)     Failure by any person, including the Chief Hearing Examiner of the Office of
Zoning and Administrative Appeals, to comply with this [subtitle] PART V is not grounds
for invalidation of any decision by the County Council, sitting as the District Council, for
which a disclosure statement is required.

PART VI. MONTGOMERY AND PRINCE GEORGE'S COUNTIES — SPECIAL PROVISIONS

FOR LOBBYING DISCLOSURE.

GENERAL REVISOR'S NOTE:

The Ethics Law Code Revision Committee has chosen to leave former Art. 40A, §
6-304 essentially unrevised, making only renumbering and minor stylistic changes.

The revised Maryland Public Ethics Law contains general definitions, applicable to
the entire revised Title 15, that are derived with some alteration from the general
definitions of former Art. 40A. The Ethics Law Code Revision Committee does not
intend that the revised definitions be applied to this Part VI in such a way as to affect the
meaning of this Part.

[6-304.] 15-844.

(a) [(1)] In this [section] PART VI the following words have the meanings
indicated.

[(2)] (B) "Candidate" has the meaning stated in Article 33, § 1-1(a) of the
Code, but only as it applies to a candidate seeking election as a local official.

[(3)] (C) "Contribution" and "political committee" have the meanings
stated in Article 33, § 1-1(a) of the Code.

[(4)] (D) "Lobbyist" means a person required to register under § 2-295 of
the Prince George's County Code or § 19A-21 of the Montgomery County Code.
