Ch. 533

1995 LAWS OF. MARYLAND

IF A COMMISSIONER OF THE WASHINGTON SUBURBAN TRANSIT COMMISSION
HOLDS ANOTHER PUBLIC OFFICE AND IS REQUIRED TO FILE A FINANCIAL
DISCLOSURE STATEMENT UNDER ANOTHER STATE OR LOCAL LAW, THE
COMMISSIONER MAY COMPLY WITH SUBSECTION (A) OF THIS SECTION BY
SUBMITTING A COPY OF THE STATEMENT FILED IN ACCORDANCE WITH THE OTHER
LAW. THE STATEMENT SHALL BE SUPPLEMENTED TO INCLUDE ANY ADDITIONAL
INFORMATION REQUIRED BY THIS SECTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 40A, § 6-203(a)(l), (2), (3), and (7):

Subsection (b) of this section makes explicit what only was implied in former
Art. 40A, §§ 4-101(a)(l) and 6-203: that commissioners and applicants are
required to file the same disclosure form as other public officials, subject to
the stated modifications.

In subsection (b)(2) of this section, reference in the former law to the time of
filing and the information to be included is deleted as unnecessary in light of
the words "as prescribed in § 15-602 of this title".

In subsection (e) of this section, the word "supplemented" is substituted for
the former word "amended" for clarity.

Defined terms: "Bicounty commission" § 15-102
"Commissioner" § 15-818
"County" § 1-101

15-821. SAME — APPLICANTS.

(A)     GENERALLY.

AN APPLICANT FOR APPOINTMENT AS COMMISSIONER SHALL FILE THE
FINANCIAL DISCLOSURE STATEMENT REQUIRED BY THIS PART III AS PRESCRIBED
IN THIS SECTION.

(B)     PLACE OF FILING.

THE STATEMENT SHALL BE FILED WITH THE COUNTY COUNCIL AND THE CHIEF
ADMINISTRATIVE OFFICER OF THE COUNTY FROM WHICH THE APPLICANT SEEKS
APPOINTMENT.

(C)     MARYLAND-NATIONAL CAPITAL PARK AND PLANNING COMMISSION.

(1) IN MONTGOMERY COUNTY, AN APPLICANT FOR APPOINTMENT OR
REAPPOINTMENT TO THE MARYLAND-NATIONAL CAPITAL PARK AND PLANNING
COMMISSION SHALL FILE THE STATEMENT NOT LATER THAN 5 DAYS BEFORE THE
INITIAL DATE SET FOR THE INTERVIEW BY THE COUNTY COUNCIL. THE STATEMENT
SHALL COVER THE 12-MONTH PERIOD ENDING 60 DAYS BEFORE THE INITIAL DATE
SET FOR THE INTERVIEW.
