Ch. 533                                    1995 LAWS OF MARYLAND

In subsections (a) and (c) of this section, the word "officials" is added for
clarity, in light of the applicability of other provisions of former Art. 40A, Title
6A to "officials" of a school system, e.g., arguably the superintendent. and
principals.

In subsection (c) of this section, the defined term "county" is substituted for
the former words "county or City of Baltimore". Similarly, the former words
"or city" are deleted as included in the defined term "county".

Also in subsection (c) of this section, the words "and maintains" are added to
clarify that a school board may not avoid coverage by adopting, and then
repealing, the specified regulations.

Also in subsection (c) of this section, the former reference to the December
31, 1983 deadline is deleted as obsolete.

15-813. FINANCIAL DISCLOSURE.

(A)     ADOPTION OF REGULATIONS.

(1)     A SCHOOL BOARD MAY ADOPT FINANCIAL DISCLOSURE
REGULATIONS APPLICABLE TO MEMBERS OF THE SCHOOL BOARD AND TO
OFFICIALS AND EMPLOYEES OF THAT SCHOOL SYSTEM IN ACCORDANCE WITH THIS
SECTION.

(2)      (I) THE REGULATIONS ADOPTED UNDER PARAGRAPH (1) OF THIS
SUBSECTION SHALL APPLY TO:

1.       EACH MEMBER OF THE SCHOOL BOARD;

2.       IF THE SCHOOL BOARD IS AN ELECTED BOARD UNDER
TITLE 3, SUBTITLE 1, PART III OF THE EDUCATION ARTICLE, EACH CANDIDATE FOR
ELECTION TO THE SCHOOL BOARD;

3.       THE SUPERINTENDENT OF THAT SCHOOL SYSTEM; AND

4.       SUBJECT TO SUBPARAGRAPH (II) OF THIS PARAGRAPH,
THOSE OTHER OFFICIALS AND EMPLOYEES OF THAT SCHOOL SYSTEM DESIGNATED
BY THE SCHOOL BOARD.

(II) THE REGULATIONS MAY NOT APPLY TO A CLASSROOM
TEACHER UNLESS THE TEACHER HAS ADDITIONAL DUTIES, NOT NORMALLY
EXPECTED OF CLASSROOM TEACHERS, THAT CAUSE THE TEACHER FOR OTHER
REASONS TO BE COVERED BY THE FINANCIAL DISCLOSURE REGULATIONS.

(B)     SIMILARITY TO STATE ETHICS LAW.
