1995 LAWS OF MARYLAND

(II) A NONCOMPENSATED APPOINTEE OF EITHER OR BOTH OF THE
PRESIDING OFFICERS.

(C) STATEMENTS.

A STATEMENT FILED UNDER THIS SECTION IS A PUBLIC RECORD AND SHALL
CONTAIN THE RELEVANT INFORMATION CONCERNING THE FINANCIAL AFFAIRS OF
THE INDIVIDUAL SUBMITTING THE STATEMENT THAT IS CONSIDERED NECESSARY
BY THE APPLICABLE DESIGNATING AUTHORITY.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 40A, § 4-106.

The phrase in the lead-in to former Art. 40A, § 4-106 specifying individuals
"holding State positions compensated in whole or in part by public funds" is
deleted in view of the more precise references to "employee" in items (1), (2),
and (3) of former § 4-106.

SUBTITLE 7. LOBBYING.

15-701. GENERALLY.

(A) REGISTRATION REQUIRED.

UNLESS EXEMPTED UNDER SUBSECTION (B) OF THIS SECTION, AN ENTITY
SHALL REGISTER WITH THE ETHICS COMMISSION AS PROVIDED IN THIS SUBTITLE,
AND SHALL BE A "REGULATED LOBBYIST" FOR THE PURPOSES OF THIS TITLE, IF,
DURING A REPORTING PERIOD, THE ENTITY:

(1)      FOR THE PURPOSE OF INFLUENCING LEGISLATIVE ACTION:

(I)       COMMUNICATES WITH AN OFFICIAL OR EMPLOYEE OF THE
LEGISLATIVE BRANCH OR EXECUTIVE BRANCH IN THE PRESENCE OF THAT
OFFICIAL OR EMPLOYEE; AND

(II)     EXCLUSIVE OF THE PERSONAL TRAVEL OR SUBSISTENCE
EXPENSES OF THE ENTITY OR A REPRESENTATIVE OF THE ENTITY, INCURS
EXPENSES OF AT LEAST $100 OR EARNS AT LEAST $500 AS COMPENSATION;

(2)      IN CONNECTION WITH OR FOR THE PURPOSE OF INFLUENCING
EXECUTIVE ACTION, SPENDS A CUMULATIVE VALUE OF AT LEAST $100 FOR MEALS,
BEVERAGES, SPECIAL EVENTS, OR GIFTS ON ONE OR MORE OFFICIALS OR
EMPLOYEES OF THE EXECUTIVE BRANCH;

(3)      IS EMPLOYED TO INFLUENCE EXECUTIVE ACTION ON A
PROCUREMENT CONTRACT THAT EXCEEDS $100,000;
