15-507. DISCLOSURE OR USE OF CONFIDENTIAL INFORMATION.

EXCEPT IN THE DISCHARGE OF AN OFFICIAL DUTY, AN OFFICIAL OR
EMPLOYEE MAY NOT DISCLOSE OR USE CONFIDENTIAL INFORMATION ACQUIRED
BY REASON OF THE OFFICIAL'S OR EMPLOYEE'S PUBLIC POSITION AND NOT
AVAILABLE TO THE PUBLIC:

(1)      FOR PERSONAL ECONOMIC BENEFIT; OR

(2)     FOR THE ECONOMIC BENEFIT OF ANOTHER.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 40A, § 3-107.

The Ethics Law Code Revision Committee has construed this section narrowly
to apply only to disclosures for economic benefit. Other provisions of law deal
with disclosures of confidential information for noneconomic motives. See,
e.g., Title 2, Subtitle 3 of the State Personnel and Pensions Article and Title
10, Subtitle 6, Part III of the State Government Article.

15-508. PARTICIPATION IN PROCUREMENT CONTRACTS.

AN INDIVIDUAL WHO ASSISTS AN EXECUTIVE UNIT IN THE DRAFTING OF
SPECIFICATIONS, AN INVITATION FOR BIDS, OR A REQUEST FOR PROPOSALS FOR A
PROCUREMENT CONTRACT, OR A PERSON THAT EMPLOYS THE INDIVIDUAL, MAY
NOT:

(1)     SUBMIT A BID OR PROPOSAL FOR THAT PROCUREMENT CONTRACT;
OR

(2)     ASSIST OR REPRESENT ANOTHER PERSON, DIRECTLY OR
INDIRECTLY, WHO IS SUBMITTING A BID OR PROPOSAL FOR THAT PROCUREMENT
CONTRACT.
