Ch. 3                                       1995 LAWS OF MARYLAND

(i) the member is unable or refuses to submit an application for
disability retirement;

(ii) the [Superintendent] SECRETARY believes the member to be
permanently physically or mentally incapable of performing assigned duties;

(iii) there is sufficient medical evidence in the form of a professional
opinion of an independent medical practitioner who has recognized expertise in the
diagnosis and treatment of the specified illness of the officer to support the
[Superintendent's] SECRETARY'S determination of permanent disability;

(iv) the onset of the disability occurred at least 1 year; and

(v) any administrative leave granted under Article 88B, § 23A of the
Code has expired.

DRAFTER'S NOTE:

Subsection (c)(2) of this section is amended to reflect the establishment of the
Department of State Police as a principal department of State government by
Chs. 165 and 166, Acts of 1994, to reflect the status of the head of the
Department as a Secretary of a principal department of State government,
and to delete surplus language.

If the Board of Trustees approves an application for disability retirement for a
member of the State Police Retirement System that was filed by the [Superintendent]
SECRETARY of the [Maryland] State Police under § 29-103(c) of this subtitle or Article
88B, § 15(b)(16) of the Code, the member:

(1)     within 90 days after approval, may exercise an option as provided under
§§ 21-402 and 21-403 of this article; or

(2)     shall receive the basic allowance.
DRAFTER'S NOTE:

This section is amended to reflect the status of the head of the Department of
State Police as the Secretary of a principal department of State government in
light of Chs. 165 and 166, Acts of 1994 and to delete surplus language.

Article - Tax - General                       

2-107.

(b) (1) The DEPARTMENT OF [Maryland] State Police shall help the State
Motor Fuel Enforcement Unit in enforcing the motor carrier tax and motor fuel tax laws.

(2) The Comptroller shall pay the salaries and expenses of all
DEPARTMENT OF [Maryland] State Police staff assigned to the State Motor Fuel
Enforcement Unit.
