(J) ETHICS COMMISSION.

"ETHICS COMMISSION" MEANS THE STATE ETHICS COMMISSION.

REVISOR'S NOTE: This subsection formerly was Art. 40A, § 1-201(f).

The word "Ethics" is added for clarity.

(K) EXECUTIVE ACTION.

"EXECUTIVE ACTION" MEANS AN ACT FOR WHICH THE EXECUTIVE BRANCH OF
STATE GOVERNMENT IS RESPONSIBLE AND THAT IS TAKEN BY AN OFFICIAL OR
EMPLOYEE OF THAT BRANCH.

(L) EXECUTIVE UNIT.

(1)     "EXECUTIVE UNIT" MEANS A DEPARTMENT, AGENCY, COMMISSION,
BOARD, COUNCIL, OR OTHER BODY OF STATE GOVERNMENT THAT:

(I)      IS ESTABLISHED BY LAW; AND

(II)     IS NOT IN THE LEGISLATIVE BRANCH OR THE JUDICIAL
BRANCH OF STATE GOVERNMENT.

(2)     "EXECUTIVE UNIT" INCLUDES A COUNTY HEALTH DEPARTMENT
UNLESS THE EMPLOYEES OF THE DEPARTMENT ARE EXPRESSLY DESIGNATED AS
"LOCAL OFFICIALS" IN § 15-807 OF THIS TITLE.

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 40A, § 1-201(1).

The defined term "executive unit" is substituted for the former term
"executive agency" for conformity with other revised articles.

The reference to the "Baltimore City Health Department" is deleted in light
of the inclusion of Baltimore City in the defined term "county".

The phrase "and the respective department's officials and employees" at the
end of former Art. 40A, § 1-201(1) is deleted as surplusage.
