AN ACT concerning

Local Health Officers - Outside Practice

FOR the purpose of repealing modifying restrictions barring certain local health officers
who are physicians from engaging in certain activities; and generally relating to local
health officers.

BY repealing and reenacting, with amendments,
Article - Health - General.
Section 3-303

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

[3-303.

(A) If a health officer or deputy of a health officer is a physician, the health officer
or deputy may not:

(1) Practice medicine, except in the performance of any official duties; or

(2) Engage in any occupation that conflicts with the performance of any
official duties.] PRACTICE MEDICINE AS LONG AS THE LOCAL GOVERNING BODY
SEEKS AND RECEIVES APPROVAL FROM THE SECRETARY WITH THE APPROVAL OF
THE LOCAL GOVERNING BODY.

(B) THE LOCAL GOVERNING BODY SHALL NOTIFY THE SECRETARY OF ITS
APPROVAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.
