(2)     That portion of the Atlantic Ocean within the boundaries of the State;

(3)     The Chesapeake Bay and its tributaries;

(4)     All ponds, lakes, rivers, streams, public ditches, tax ditches, and public
drainage systems within the State, other than those designed and used to collect, convey,
or dispose of sanitary sewage; and

(5)     The floodplain of free-flowing waters determined by the Department OF
THE ENVIRONMENT on the basis of the 100-year flood frequency.

SECTION 8. 9. AND BE IT FURTHER ENACTED, That except otherwise
provided in this Act, nothing in this Act affects the term of office of an appointed
member of any board, commission, committee, or other agency or unit. A person who is
a member of such a unit on the effective date of this Act shall remain a member for the
balance of the term to which the person was appointed, unless the person sooner dies,
resigns, or is removed pursuant to the provisions of law.

SECTION 9. 10. AND BE IT FURTHER ENACTED, That, except as expressly
provided to the contrary in this Act, any transaction affected by or flowing from any
statute here amended, repealed, or transferred, and validly entered into before the
effective date of this Act and every right, duty, or interest following from it remains valid
after the effective date of this Act and may be terminated, completed, consummated, or
enforced pursuant to law.

SECTION 10. 11. AND BE IT FURTHER ENACTED, That, except as otherwise
provided in this Act, all permits and licenses, applications for permits and licenses, rules
and regulations, proposed rules and regulations, standards and guidelines, proposed
standards and guidelines, orders and other directives, forms, plans, memberships, special
funds, appropriations, grants, applications for grants, contracts, properties, investigations,
administrative and judicial proceedings, rights to sue and be sued, and all other duties
and responsibilities associated with those functions transferred by this Act shall continue
in effect under the Secretary of the Environment or the appropriate board, council, or
other unit within the Department, until completed, withdrawn, canceled, modified, or
otherwise changed pursuant to law.

SECTION 11. 12. AND BE IT FURTHER ENACTED, That if any provision of
this Act or the application thereof to any person or circumstance is held invalid for any
reason in a court of competent jurisdiction, the invalidity does not affect other provisions
or any other application of this Act which can be given effect without the invalid provision
or application, and for this purpose the provisions of this Act are declared severable.

SECTION 12. AND BE IT FURTHER ENACTED, That the captions and other

eadings in this Act are for guidance only and are not intended to become law.

SECTION 13. AND BE IT FURTHER ENACTED, That the publishers of the
Annotat
ed Code of Maryland are directed to propose a plan for the correction of
numerical and similar nonnum
erical cross-references throughout the Annotated Code
that refer to provisions found in the Environment Article.

SECTION 12. 13. AND BE IT FURTHER ENACTED, That all persons who are,
as of June 30, 1995, classified employees of the Department of Natural Resources and
