1995 LAWS OF MARYLAND

(i) The [ratio] NUMBER of CONSUMER complaints filed during the
cal
endar year against each insurer [for each major line of insurance written by the
insurer]; and

(ii) A summary of the resolution of the complaints BROKEN DOWN BY
THE NUMBER OF JUSTIFIED COMPLAINTS AND UNJU
STIFIED COMPLAINTS.

(c) The terms of the contract required under this section shall provide at a
minimum that:

(8) The [notes] RATES, terms, and purposes of commissions, charges, and
other fees that the reinsurance manager may impose against the reinsurer are set out;

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article - Insurance

2-110.

(a) As early in each fiscal year as is reasonably possible the Commissioner shall
prepare an annual report about the previous fiscal year that includes:

(5)    the [ratio] NUMBER of CONSUMER complaints filed during the
calendar year a
gainst each insurer [for each major line of insurance written by the
insurer] and a summary of the resolution of the complaints BROKEN DOWN BY THE
NUMBER. OF JUSTIFIED COMPLAINT
S AND UNJUSTIFIED COMPLAINTS;

(b) The Commissioner may deny a certificate of authority to an applicant or,
subject to the hearing provisions of Title 2 of this article, refuse to renew, suspend, or
revoke a c
ertificate of authority if the applicant or holder of the certificate of authority;

(1) violates any provision of this article other than one that provides for
mandatory d
enial, refusal to renew, suspension, or revocation for its violation;

(2)     knowingly fails to comply with a regulation or order of the
Commissioner;

(3) is found by the Commissioner to be in unsound condition or in a
condition that rend
ers further transaction of insurance business hazardous to the
insurer'
s policyholders or the public;

(4)     is engaged in writing policies in a jurisdiction in which it operates on a
premium basis that the Commissioner finds to be insufficient, insecure, or impracticable
so as to
endanger the solvency of the insurer;

(5) refuses or delays payment of amounts due claimants without just cause;

(6)     refuses to be examined or to produce its accounts, records, or files for
examination by the Commissioner wh
