CHAPTER 469

AN ACT concerning

(House Bill 1136)

Strip Mining - Lands Eligible for Remining

FOR the purpose of altering the period for which certain persons engaged in surface coal
mining are responsible for successful revegetation following approval of a certain
report by the Department of Natural Resources if the land is eligible for remining;
limiting the duration of certain authority; defining "land eligible for remining";
making a conforming change; repealing certain definitions; and generally relating to
the reclamation of land and the regulation of strip mining on land eligible for
remining operations.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Natural Resources

7-501.

(a) In this subtitle the following words have the meanings indicated.

(m) ["Net project construction cost" means the part of the project construction
cost paid from the revolving account equal to the project construction cost less the cash
contribution of the owner of the benefited property on completion of construction.]
"LAND ELIGIBLE FOR REMINING" MEANS ANY LAND THAT WOULD OTHERWISE BE
ELIGIBLE FOR EXPENDITURES UNDER SUBTITLE 9 OF THIS TITLE.

(w) ["Project construction cost" means total cost to construct an orphaned land
reclamation project, exclusive of design, supervision, inspection and maintenance costs.

(x)] "Prospect" means the removal of soil or rock material overlying bituminous
coal to determine the location or value of the coal resource of the area, but not to sell,
exchange, or transfer.
