[(b) Any individual who, for at least 7 consecutive years before June 1, 1966, was
director of a medical laboratory that met the standards and qualifications for medical
laboratories in effect before June 1, 1966 shall be deemed to meet the academic and
experi
ence qualifications for directors that the Secretary sets under this section.]

17-204.

The Secretary:

(1)     Shall set reasonable LICENSING fees [for the issuance and renewal of
permits]; AND

(2)     May set a fee for the CYTOLOGY proficiency testing program [; and

(3)     Shall set reasonable fees for an application for an exception to the
permit requirements under § 17-205 of this subtitle].

17-205.

(a)     [Except as otherwise provided in this subtitle, a] A person shall hold a
[permit] LICENSE issued by the Secretary before the person may:

(1)     [Operate a] OFFER OR PERFORM medical laboratory TESTS OR
EXAMINATIONS in this State;

[(2) Represent or service in this State any medical laboratory that is outside
this State; or

(3) Perform tests or examinations pertaining to individuals in this State at a
medical laboratory located outside this State.]

(2)     OFFER OR PERFORM MEDICAL LABORATORY TESTS OR
EXAMINATIONS ON SPECIMENS ACQUIRED FROM HEALTH CARE PROVIDERS IN THIS
STATE AT A MEDICAL LABORATORY LOCATED OUTSIDE THIS STATE; OR

(3)     REPRESENT OR SERVICE IN THIS STATE A MEDICAL LABORATORY
REGARDLESS OF THE LABORATORY'S LOCATION.

(b)     The Secretary shall [grant an] ISSUE A LETTER OF exception [to the permit
requirements of this subtitle for any physician or group of physicians that] TO A
LABORATORY THAT:

[(1) Performs or personally supervises medical laboratory procedures only
for the physician's patients or patients of the group;

(2)     Performs only limited laboratory examinations as defined in subsection
(c) of this section; and

(3)     Continues to meet the requirements under § 17-212 of this subtitle.]

(1) PERFORMS ONLY LIMITED MEDICAL LABORATORY TESTS OR
EXAMINATIONS; AND
