members of the Department of [Maryland] State Police to be appointed by the Board of
Public Works. Said board shall be organized immediately after three of such trustees have
qualified and taken the oath of office. The Secretary of Personnel shall be responsible for
such administrative functions as had previously been performed by the Director of
retirement systems to carry out the duties and business of the board of trustees; however,
the Secretary of Personnel is authorized to delegate to the assistant secretary of
personnel for retirement systems such of these administrative functions as the Secretary
deems appropriate.
(b) On and after June 1, 1947, or as soon thereafter as the said board of trustees
is organized, the functions, duties and obligations of the [Superintendent] SECRETARY
of THE State Police with respect to the administration of the retirement and pension
system, established by this subtitle, are hereby transferred and vested in the said board of
trustees.
(c) Whenever the term ["Superintendent of State Police" or "Superintendent of
the Department of Maryland State Police"] SECRETARY is used in this subtitle with
respect to the administration of the said retirement and pension system or with respect to
contributions thereto, such term shall be taken to mean the said board of trustees.

This section is amended to reflect the status of the head of the Department of
State Police as the Secretary of a principal department of State government in
light of Chs. 165 and 166, Acts of 1994, to make stylistic changes, and to delete
surplus language.

(b) The board of county commissioners or county council of any county, or the
Mayor and City Council of the City of Baltimore, and the [Superintendent of the
Department] SECRETARY may conclude an agreement that the Department act as and
take over all or a portion of the functions of a local police force for the county, or
municipality. Local governing bodies are hereby authorized and empowered to enter into
such contractual agreements with municipalities located therein for the participation of
the municipalities in the contractual agreements entered into by the local governing
bodies and the [State Police] DEPARTMENT. In Charles and St. Mary's Counties
municipalities also may enter into separate contractual agreements with the [State
Police] DEPARTMENT.
(d) Every agreement shall provide that the reasonable and proper cost of the
Local Division, for and within the particular county be determined by the
[Superintendent of the Maryland State Police] SECRETARY and that the county or
municipality shall reimburse the DEPARTMENT [Maryland State Police] an amount
equal to 100% of the cost so determined. The agreement further shall provide for the
time and manner of payments by the county or municipality to the DEPARTMENT
[Maryland State Police] to pay this obligation.
