Ch. 401

1995 LAWS OF MARYLAND

(2) FOR PURPOSES OF THIS SECTION, "BUSINESS" INCLUDES MEANS A
PERSON OR ENTITY, REGARDLESS OF LEGAL STRUCTURE, INCLUDING A
CORPORATION, PARTNERSHIP, LIMITED LIABILITY COMPANY, PROFESSIONAL
AS
SOCIATION, PROFESSIONAL SERVICE CORPORATION, OR SOLE PROPRIETOR
THROUGH WHICH REAL ESTATE BROKERAGE SERVICES ARE PROVIDED.

(3) "INTEREST IN A BUSINESS" MEANS, IN THE CASE OF A BUSINESS
THAT IS IN A CORPORATION, THE OUTSTANDING VOTING STOCK OF THE
CORPORATION THROUGH WHICH REAL ESTATE BROKERAGE SERVICES ARE PROVIDED.

(B) (1) NOT MORE THAN 49% OF THE INTEREST IN A BUSINESS THROUGH
WHICH REAL ESTATE BROKERAGE
SERVICES ARE PROVIDED MAY BE HELD
DIRECTLY OR INDIRECTLY BY ASSOCIATE REAL ESTATE BROKERS, REAL ESTATE
SALESPERSONS, OR ANY COMBINATION OF ASSOCIATE BROKERS OR SALESPERSONS,
INCLUDING PROFESSIONAL SERVICE CORPORATIONS.

(C) (2) AN INTEREST OF A LICENSEE IN A BUSINESS THROUGH WHICH REAL
ESTATE BROKERAGE SERVICES ARE PROVIDED SHALL INCLUDE ANY INTEREST IN
THE BUSINESS HELD BY AN IMMEDIATE FAMILY MEMBER OF THE LICENSEE.

(D) (C) EXCEPT AS TO THE LIMITATION OF INTEREST OF THE PROFESSIONAL
SERVICE CORPORATION IN A BUSINESS THROUGH WHICH REAL ESTATE BROKERAGE
SERVICES ARE PROVIDED.
THIS SECTION DOES NOT AFFECT THE FORMATION OF A
PROFESSIONAL SERVICE CORPORATION BY ASSOCIATE REAL ESTATE BROKERS AND
REAL ESTATE SALESPERSONS AUTHORIZED BY § 17-512 OF THIS SUBTITLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

(Senate Bill 777)

AN ACT concerning

Disinterment and Reinterment of Human Remains - Records

FOR the purpose of requiring the Department of Health and Mental Hygiene to keep
certain records of permits issued for the disinterment and reinterment of human
remains; prohibiting the Department from disclosing to the public certain
information regarding sites of disinterments and reinterments under certain
conditions; requiring the Department to allow certain persons to inspect certain
public records regarding disinterments and reinterments; making certain stylistic
changes; and generally relating to disinterments and reinterments of human
remains.

BY repealing and reenacting, with amendments,
