(I) considered a subcontractor under § 9-508 of this title; HOWEVER,
SUCH AN INDIVIDUAL OWNER OPERATOR IS NOT A COVERED EMPLOYEE OF
HIMSELF OR HERSELF AS SUBCONTRACTOR AND IS NOT ENTITLED TO
COMPENSATION FROM A PRINCIPAL CONTRACTOR UNDER § 9-508 OF THIS TITLE

(II)     FOR PURPOSES OF BEING A SUBCONTRACTOR, NOT CONSIDERED
A COVERED EMPLOYEE OF THE ENTITY THAT THE INDIVIDUAL OPERATOR OWNS; AND

(III)   NOT ENTITLED TO COMPENSATION FROM A PRINCIPAL
CONTRACTOR UNDER § 9-508 OF THIS TITLE.

(c) An individual who is an owner operator of a Class F (tractor) vehicle and
enters into a written agreement under subsection (a) of this section shall provide proof of
insurance for any covered employee of the individual as may be required by this title.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning

Schools - Possession of Portable Pagers - Discretionary Arrest

FOR the purpose of altering the law prohibiting the possession of certain portable pagers
on public school property; requiring a law enforcement officer to make a certain inquiry
under certain circumstances; making the arrest of an individual who violates that law
discretionary rather than mandatory; and generally relating to the possession of
portable pagers on public school property.
