Ch. 372                                    1995 LAWS OF MARYLAND

[29-113.

(a)     (1) This subsection applies to:

(i)     the Correctional Officers' Retirement System;

(ii)    the Employees' Retirement System;

(iii)   the State Police Retirement System; and

(iv)    the Teachers' Retirement System.

(2) A member may receive a disability retirement allowance for a disability
incurred before enrollment only to the extent that the disability was aggravated in the
actual performance of duty.

(b)     (1) This subsection applies to:

(i)     the Employees' Pension System;

(ii)    the Local Fire and Police System;

(iii)   the Natural Resources Pension System; and

(iv)   the Teachers' Pension System.

(2)     A member may receive a disability retirement allowance for a disability
incurred before enrollment only to the extent that the disability was aggravated after
enrollment.

(3)     For the purpose of this subsection, a member keeps the enrollment date
set in the State system from which the member transferred, if the member transferred:

(i) from the Employees' Retirement System or the Teachers'
Retirement System to the Employees' Pension System or Teachers' Pension System; or

(ii) from the Employees' Retirement System or the Employees'
Pension System to the Local Fire and Police System or the Natural Resources Pension
System.]

29-115.

(a)     If a disability retiree is under normal retirement age, the Board of Trustees
may require the disability retiree to undergo a yearly medical examination.

(b)     (1) The retiree shall be examined by a physician chosen by the Board of
Trustees.

(2) The examination shall be at the retiree's residence or other place agreed
on by the retiree and the physician conducting the examination.

(c)     If a retiree who is under normal retirement age refuses a medical examination,
the Board of Trustees may stop payment of the retiree's allowance until the retiree
withdraws the refusal.
