2.

The following words shall have the meanings contained in this section unless the
context manifestly indicates a different meaning:

(2)     "Commissioned rank" means the ranks of Second Lieutenant, First
Lieutenant, Captain, Major, and Lieutenant Colonel. "Noncommissioned rank" means
any other rank. Neither term includes the [Superintendent] SECRETARY.

(3)     "Department" means the DEPARTMENT OF [Maryland] State Police.

(4)     "Employee" means any employee of the Department. A "police
employee" is an employee to whom the [Superintendent] SECRETARY assigns the
powers contained in § 4 OF THIS ARTICLE. A "civilian employee" is an employee other
than a police employee.

(8)     "Rule" means any rule, regulation, order or other directive adopted by
the [Superintendent] SECRETARY pursuant to this article. A rule is not for any purpose
a rule within the meaning of Title 10, Subtitle 1 of the State Government Article.

(9)     "Obsolete rank" means any rank designated by the [Superintendent]
SECRETARY to which no further promotions will be made.

(10)    "SECRETARY" MEANS THE SECRETARY OF THE STATE POLICE.
DRAFTER'S NOTE:

Paragraphs (2), (3), (4), (8), and (9) of this section are amended to reflect the
establishment of the Department of State Police as a principal department of
State government by Chs. 165 and 166, Acts of 1994, to reflect the status of the
head of the Department as a Secretary of a principal department of State
government, to make a stylistic change and to delete surplus language.
Paragraph (10) of this section is added to avoid repetition of the full title of
the Secretary.

(b)     The [Superintendent] SECRETARY, the deputy [superintendent]
SECRETARY, and employees designated by the [Superintendent] SECRETARY as police
employees shall have throughout the State the same powers, privileges, immunities, and
defenses as sheriffs, constables, police officers, and other peace officers possessed at
common law and may now or hereafter exercise within their respective jurisdictions. Any
warrant of arrest may be executed by a police employee in any part of the State without
further endorsement.

(c)     Police employees shall not act within the limits of any incorporated
municipality which maintains a police force except: (1) when in pursuit of an offender or
suspected offender; (2) when in search of an offender or suspected offender wanted for a
crime committed outside of the limits of the municipality, or when interviewing or seeking
to interview a witness or supposed witness to such a crime; (3) when a crime is committed
in the presence of the police employee, the arrested party shall be immediately
transferred to the custody of the local law enforcement agency; (4) when requested to act
