Ch. 352                                    1995 LAWS OF MARYLAND

(5)     The Commissioner may appoint and employ field investigators,
ACCOUNTANTS, AND STATISTICIANS whose primary duties shall be, as directed by the
Commissioner, to make investigations in this State of violations or claimed violations of
this article, INCLUDING § 233A OF THIS ARTICLE.

(6)     The Commissioner may appoint and employ other assistants and clerks as may
be necessary to assist him in discharging the duties imposed upon him under this article.

(7)     The Administration shall be represented by the office of the Attorney General
and shall have a principal counsel who shall be an assistant attorney general and such
other assistant attorneys general, INCLUDING ASSISTANT ATTORNEYS GENERAL
SPECIFICALLY ASSIGNED TO THE FRAUD DIVISION, as provided by the budget. The
Commissioner may employ on a full-time basis such other attorneys-at-law as the
Commissioner deems necessary.

(8)     THE COMMISSIONER MAY EMPLOY SUCH PERSONNEL AS IS NECESSARY
TO CARRY OUT THE DUTIES OF THE INSURANCE FRAUD DIVISION, INCLUDING
INVESTIGATORS, ATTORNEYS AT LAW. ACCOUNTANTS, AND STATISTICIANS.

[(8)](9) The Commissioner may from time to time contract for and procure, on a
fee or part-time basis, or both, such actuarial, legal, technical or other professional
services as he may require for the discharge of his duties.

33A.

(A) All money received under §§ 33(i), 41(1), (2), (3), (4) and (16), and 194 of this
article shall be general funds of the State, except that money for travel expenses and
living expense allowance received pursuant to § 33(i) of this article shall be held in a
special revolving fund by the Comptroller for the sole purpose of the payment of the costs
of examinations of insurance companies.

(B) THE FOLLOWING MONEYS MAY NOT BE CONSIDERED GENERAL FUNDS OF
THE STATE AND SHALL BE DEPOSITED IN THE INSURANCE FRAUD DIVISION FUND:

(1) REVENUE DERIVED FROM THE ANNUAL FRAUD PREVENTION FEE
UNDER § 640B OF THIS ARTICLE; AND

(2) INCOME FROM INVESTMENTS THAT THE STATE TREASURER MAKES FOR
THE INSURANCE FRAUD DIVISION FUND.

SECTION 4. AND BE IT FURTHER ENACTED. That the Laws of Maryland
read as follows:

Article 48A - Insurance Code

233A.

(A)     IN THIS SECTION AND §§ 233AB THROUGH 233B OF THIS SUBTITLE,
INCLUSIVE, THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED.

(B)     "FRAUD DIVISION" MEANS THE INSURANCE FRAUD DIVISION OF THE
MARYLAND INSURANCE ADMINISTRATION.
