(2)     Any delegation of authority may be modified or rescinded by the Board
of Regents at any time in whole or in part.

(J) BY SEPTEMBER 1 OF EACH YEAR, THE BOARD SHALL SUBMIT AN ANNUAL
POSITION ACCOUNTABILITY REPORT TO THE DEPARTMENT OF BUDGET AND FISCAL
PLANNING. DEPARTMENT OF FISCAL SERVICES, AND THE MARYLAND HIGHER
EDUCATION COMMISSION REPORTING THE TOTAL POSITIONS AUTHORIZED
CREATED AND THE COST AND THE FUNDING SOURCE FOR ANY POSITIONS CREATED
BY THE UNIVERSITY IN THE PREVIOUS FISCAL YEAR.

12-105.

(G) (1) EXCEPT AS OTHERWISE EXPRESSLY PROVIDED IN THE STATE
FINANCE AND PROCUREMENT ARTICLE OR ANY OTHER PROVISION OF LAW, THE
BOARD
SHALL ESTABLISH PROCUREMENT STANDARDS AND PROCEDURES FOR THE
UNIVERSITY, INCLUDING PROCEDURES FOR THE PROCUREMENT OF SUPPLIES
FUNDED BY GENERAL OBLIGATION BONDS.

(2)      THE STANDARDS AND PROCEDURES SHALL BE SUBMITTED TO THE
BOARD OF PUBLIC WORKS FOR APPROVAL NO LATER THAN 60 DAYS PRIOR TO
THEIR EFFECTIVE DATE. IF NO REVIEW IS UNDERTAKEN WITHIN THE PERIOD, THE
STANDARDS AND PROCEDURES SHALL BE CONSIDERED EFFECTIVE AT THE LAPSE
OF THE PERIOD. THE PROCEDURES
SHALL INCORPORATE THE FOLLOWING
PROVISION
S OF THE STATE FINANCE AND PROCUREMENT ARTICLE:

(I) § 11-205 (FRAUD IN PROCUREMENT);

(II) §12-109 (BOARD OF PUBLIC WORKS APPROVAL FOR
DESIGNATED CONTRACTS);

(III) TITLE 12, SUBTITLE 2 (SUPERVISION OF CAPITAL

EXPENDITURES AND REAL PROPERTY LEASES);

(IV) § 13-219 (REQUIRED CLAUSES - NONDISCRIMINATION CLAUSE);

(V) § 13-221 (DISCLOSURES TO SECRETARY OF STATE);

(VI) TITLE 16 (DEBARMENT OF CONTRACTORS); AND

(VII) TITLE 17 (SPECIAL PROVISIONS - STATE AND LOCAL

SUBDIVISIONS).

(3) BANKING AND FINANCIAL SERVICES, INSURANCE, AND INSURANCE
SERVICES AS PROVIDED IN DIVISION I OF THE STATE FINANCE AND PROCUREMENT
ARTICLE AND ARTICLE VI, SECTION 3 OF THE MARYLAND CONSTITUTION SHALL BE
PROCURED THROUGH THE STATE TREASURER.

(4) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE BOARD
OR THE CONSTITUENT INSTITUTIONS MAY PARTICIPATE IN STATE PROCUREMENT
