(2) (I) A COMMISSIONER MAY ACCEPT THE FILING BY MAIL OF A
WRITTEN APPLICATION REQUESTING A STATEMENT OF CHARGES AGAINST A
DEFENDANT WHO HAS NOT BEEN ARRESTED FOR THE OFFENSE. THE APPLICATION
SHALL CONTAIN AN AFFIDAVIT SHOWING PROBABLE CAUSE THAT THE DEFENDANT
COMMITTED THE OFFENSE CHARGED.
(II) THE COMMISSIONER MAY REQUEST ADDITIONAL
DOCUMENTATION FROM THE AFFIANT OR REQUEST THE AFFIANT TO PERSONALLY
APPEAR.
[(2)](3) A commissioner shall advise arrested persons of their
constitutional rights, set bond or commit persons to jail in default of bond or release them
on personal recognizance if circumstances warrant, and conduct investigations and
inquiries into the circumstances of any matter presented to him in order to determine if
probable cause exists for the issuance of a charging document, warrant; or criminal
summons and, in general, perform all the functions of committing magistrates as
exercised by the justices of the peace prior to July 5, 1971.
[(3)] (4) There shall be in each county, at all times, one or more
commissioners available for the convenience of the public and police in obtaining
charging documents, warrants, or criminal summonses and to advise arrested persons of
their rights as required by law.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

AN ACT concerning
Creation of a State Debt - Baltimore City - The Avenue Market
FOR the purpose of authorizing the creation of a State Debt not to exceed $1,000,000
$800,000, the proceeds to be used as a grant to The Avenue Market Corporation for
certain development or improvement purposes; providing for disbursement of the
loan proceeds, subject to a requirement that the grantee provide and expend a
matching fund; and providing generally for the issuance and sale of bonds
evidencing the loan.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:
(1) The Board of Public Works may borrow money and incur indebtedness on
behalf of the State of Maryland through a State loan to be known as the Baltimore City
- The Avenue Market Loan of 1995 in a total principal amount equal to the lesser of (i)
$1,000,000 $800,000 or (ii) the amount of the matching fund provided in accordance with
