Article 83C - Juvenile Services

2-132.

(a)     (1) The Department shall apply to the Criminal Justice Information System
Central Repository of the Department of Public Safety and Correctional Services for a
federal and State criminal [records background investigation] HISTORY RECORDS
CHECK for [every] EACH employee of the Department, within the first month of
employment with the Department.

(2) The Criminal Justice Information System Central Repository shall
provide the requested information in accordance with Article 27, §§ 742 through 755 of
the Code.

(b)     As part of the application for a criminal [background investigation] HISTORY
RECORDS CHECK, the Department shall submit to the Criminal Justice Information
System Central Repository:

(1)     A complete set of the employee's legible fingerprints taken on standard
fingerprint cards; [and]

(2)     [Payment for the cost of the criminal background investigation] THE
MANDATORY PROCESSING FEE REQUIRED BY THE FEDERAL BUREAU OF
INVESTIGATION FOR A FEDERAL CRIMINAL HISTORY RECORDS CHECK; AND

(3)     THE FEE AUTHORIZED UNDER ARTICLE 27, § 746(B)(8) OF THE CODE
FOR ACCESS TO MARYLAND CRIMINAL HISTORY RECORDS.

Article - Business Regulation

12-204.

(a)     In this section, "Central Repository" means the Criminal Justice Information
System Central Repository of the Department of Public Safety and Correctional Services.

(b)     (1) The Secretary shall request from the Central Repository [an
investigation of the background] A FEDERAL AND STATE CRIMINAL HISTORY
RECORDS CHECK of each applicant for a license and each employee of the applicant [to
find out whether the individual has a federal or State criminal record].

(2) The Secretary shall send to the Central Repository:

(i) [a copy of the application] THE REQUEST FORM SPECIFIED BY
THE CENTRAL REPOSITORY;

(ii) [$25 of the application fee;

(iii) the $25 fee that the applicant submits for each employee] THE
MANDATORY PROCESSING FEE REQUIRED BY THE FEDERAL BUREAU OF
INVESTIGATION FOR A FEDERAL CRIMINAL HISTORY RECORDS CHECK
;

(III) THE FEE AUTHORIZED UNDER ARTICLE 27, § 746(B)(8) OF THE
CODE FOR ACCESS TO MARYLAND CRIMINAL HISTORY RECORDS; and
