CHAPTER 235
(House Bill 185)

AN ACT concerning

Worcester County - Alcoholic Beverages
(BYOB Establishments)

FOR the purpose of repealing in Worcester County the prohibition in certain
establishments of the consumption, possession, or transfer of alcoholic beverages
under certain circumstances; prohibiting the consumption of alcoholic beverages in
certain establishments, with exceptions; and generally relating to the consumption
of alcoholic beverages in Worcester County.

BY repealing and reenacting, with amendments,
Article 2B - Alcoholic Beverages
Section 11-304(k)
Annotated Code of Maryland
(1994 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

11-304.

(k) [(1) In Worcester County, if the premises constitute a restaurant, tavern,
hotel, club, dance studio, disco, or place of public entertainment, a person, club.
organization, or place of public entertainment may not knowingly allow the consumption.
possession, or transfer of alcoholic beverages except in a manner specifically permitted or
provided for by this article if:

(i) The person, club, organization, or place of public entertainment is
in possession or control of the place as owner, lessee, or user; and

(ii) The place is open to the general public or in any way licensed by
the State of Maryland or by Worcester County.]

(1)     THIS SUBSECTION APPLIES ONLY IN WORCESTER COUNTY.

(2)     EXCEPT AS OTHERWISE PROVIDED BY THIS ARTICLE AND EXCEPT
AS PROVIDED IN PARAGRAPH (3) OF THIS SUBSECTION, A PERSON MAY NOT
CONSUME ANY ALCOHOLIC BEVERAGES AT ANY TIME ON ANY DAY OF THE WEEK.
INCLUDING SATURDAY AND SUNDAY, IN ANY OF THE FOLLOWING PREMISES:

(I)      RESTAURANT;

(II)    TAVERN;

(III)   HOTEL;
