(2) (I) THOSE ESTABLISHMENTS THAT HELD A LICENSE BEFORE JULY
1, 1976, AND CONTINUED TO HOLD IT THROUGH 1990, BUT WHICH LICENSE WAS
LATER CANCELED MAY REACQUIRE A LICENSE OF THE SAME CLASS AS THOUGH
THEY HELD IT ON OR BEFORE JULY 1, 1976, NOTWITHSTANDING ANY OF THE
PROVISIONS OF ARTICLE 2B AND IF OTHERWISE APPROVED BY THE BOARD.

(II) AN APPLICATION TO REACQUIRE A LICENSE UNDER
SUBPARAGRAPH (I) OF THIS PARAGRAPH SHALL BE SUBMITTED TO THE HARFORD
COUNTY BOARD OF LICENSE COMMISSIONERS BY MARCH 1, 1996.

(e) Except as otherwise provided in this article, in Harford County, the Board of
License Commissioners may not issue or transfer to any neighborhood a Class A
(off-sale) beer and wine license, a Class A-1 or Class A-2 (off-sale) beer, wine and
liquor license, if any of these classes of licenses exist in that neighborhood. THIS
RESTRICTION DOES NOT APPLY IF THE LICENSE IS ACQUIRED PURSUANT TO THE
PROVISIONS OF PARAGRAPH (2) OF SUBSECTION (D) SUBSECTION (D)(2) OF THIS
SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That the Harford County Board
of License Commissioners shall study the issues related to the interpretation of
"neighborhood", "franchisees", and "concessionaires", as these terms are used in Article
2B, § 9-213(d) of the Code in connection with the issuance, transfer, or reacquisition of
alcoholic beverages licenses, and shall submit its findings and recommendations
concerning the clarification of these terms to the members of the General Assembly
representing Harford County by October 1, 1995 January 1, 1996.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

(Senate Bill 575)

AN ACT concerning

Harford County - Alcoholic Beverages
(Class B-3 B-4 Seafood Restaurant License)

FOR the purpose of creating in Harford County a Class B-3 B-4 seafood restaurant beer
and wine license with on-sale privileges only; specifying a percentage of average
gross monthly receipts of food commodities, location of facilities, nontransferability
of the license, the requirement for the prior existence of the seafood restaurant, and
a ban on outdoor advertising and gaming; limiting hours and days for sale;
exempting the license applicant from certain distance requirements; and generally
relating to a Class B-3 B-4 seafood restaurant license in Harford County.
