(b) Notwithstanding the placement of a unit in a principal department:

(2) a State officer or State employee who is not in the classified service of
the State Personnel Management System and is transferred with the unit remains exempt
from the provisions of the State Personnel AND PENSIONS Article that govern classified
service employees and the regulations adopted under those provisions unless the officer
or the employee is placed in the classified service in accordance with those provisions;

(b) Except as otherwise provided in subsection (e) of this section, on or before
July 1, 1991, an evaluation shall be made of the following governmental activities or units
and the statutes and regulations that relate to the governmental activities or units:

(9)     State Real Estate Commission (§ 17-201 of the Business Occupations
and Professions Article);

(10)   Real Estate Hearing Board (§ 17-325 of the Business Occupations and
Professions Article);
