35.02.07.01 35.02.07 EASTERN CORRECTIONAL INSTITUTION

(A) Central Kitchen Improvements. Construct improvements to the
Central Kitchen, provided that no funds may be expended until the
department provides to the budget committees a letter from the
Department of Health and Mental Hygiene that the renovation plan is
expected to bring the Eastern Correctional Institution production
kitchen into compliance with state health code requirements
(Somerset County)..............................................................................

35.02.08.01 35.02.08 WESTERN CORRECTIONAL INSTITUTION

(A) New Medium Security Correctional Facility. Provide a portion of
the funds to acquire property, design, construct, and equip a new
medium security correctional facility, provided that:

(1) by July 1, 1995, the Department of Public Safety and
Correctional Services has submitted to the budget committees
a food s
ervice master plan that addresses:

(a) privatization—vis-a-vis state provision of food
services in corr
ectional institutions;

(b) compares costs between construction of a new
central kitchen in the Jessup region and renovation
of current facilities;

(c) justifies the scope and cost of a new central kitchen
in the J
essup region if it proves the most cost
eff
ective and is necessary to meet demand;

(d) cost and phasing schedule for renovating existing
Baltimore and Jessup region kitchens; and

(2) until the budget committees have reviewed and commented
upon th
e report or 45 days have elapsed from the date the
report has been received by the budget committees, provided
that for the calculation of the prevailing wage under Title 17,
Subtitle 2 of the State Finance and Procurement Article and
notwithstanding the provisions of Section 17-208 of that article.
when calculating the prevailing wage rate, the Commissioner of
Labor and Industry shall not consider the wage rates paid for
projects: covered by Title 40, Section 276a of the United States
Code (Davis-Bacon Act); or projects in Allegheny, Armstrong,
Beaver, Butler, Greene, Fayette, Indiana, Washington, or
Westmoreland counties of the Commonwealth of Pennsylvania;
or the wage rates paid for construction currently completed or
underway at the Western Correctional Institution site
(Allegany
