Ch. 110                                    1995 LAWS OF MARYLAND

defendant may waive the statutory period provided for filing a postconviction
petition under certain circumstances; providing that the waiver may be revoked
under certain circumstances; altering the time line governing the filing of an initial
postconviction petition in a case in which a sentence of death has been imposed;
specifying that the revocation of a waiver under this Act shall continue the State
postconviction review process for a certain period of time;
requiring that the date of a
hearing on a certain type of postconviction petition be set within a certain period;
requiring that altering the period within which requiring that such a hearing must be
held, with certain exceptions within a certain period, within a certain period;
requiring the court to issue a decision on such a petition within a certain number of
days after the hearing; requiring a party who seeks to obtain automatic removal of a
case
under a certain constitutional provision to file a certain motion within a certain
tim
e period; prohibiting a court from granting a party's request for removal after the
time period has expired unless the party seeking removal establishes that the party
cannot obtain a fair trial or sentencing proceeding in the jurisdiction in which the
cas
e is pending; providing for the application of this Act; making certain provisions
of this Act contingent upon th
e passage of a certain Constitutional Amendment;
making certain stylistic changes; defining certain terms; making certain changes to
conform to death penalty reform; making the provisions of this Act severable; and
generally relating to the death penalty.

BY repealing and reenacting, with amendments,

Section 75, 75A, 412, 413(b) and (d), and 645A
Annotated Code of Maryland
(1992 Replacement Volume and 1994 Supplement)

BY adding to
