Ch. 64

1995 LAWS OF MARYLAND

(I)      THE RUBBISH WAS DUMPED ON THE PROPERTY WITHOUT THE
KNOWLEDGE AND CONSENT OF THE OWNER; AND

(II)     THE OWNER PROVIDES A SIGNED RELEASE OF ALL THE
OWNER'S PERSONAL AND PROPERTY CLAIMS THAT MAY ARISE FROM THE
PERFORMANCE OF THE WORK PROJECT.

(3)     A COMMUNITY SERVICE WORKER ASSIGNED TO A WORK PROJECT
UNDER THIS SUBSECTION SHALL BE INSURED BY THE COUNTY TO THE SAME
EXTENT AS ANY OTHER WORKER ASSIGNED TO A PROJECT PROVIDED BY A PRIVATE
CHARITABLE, NONPROFIT INSTITUTION OR PUBLIC AND COMMUNITY SERVICE
ASSOCIATION OR AGENCY OF GOVERNMENT UNDER THIS SECTION.

(4)      (I) IF AN OWNER HAS RECEIVED A NOTICE OF VIOLATION FROM
THE DEPARTMENT OF ENVIRONMENTAL RESOURCES BECAUSE OF RUBBISH
DUMPED WITHOUT THE OWNER'S KNOWLEDGE AND CONSENT, AND THE OWNER
APPEALS TO THE BOARD OF ADMINISTRATIVE APPEALS FOR THE COUNTY, THE
BOARD SHALL PERMIT THE OWNER TO DEFEND AGAINST THE NOTICE BY
ASSERTING THE LIABILITY OF A THIRD PARTY, WHOSE IDENTITY MAY BE KNOWN
OR UNKNOWN TO THE OWNER.

(II) IF THE BOARD DECIDES IN FAVOR OF THE OWNER, THE BOARD
SHALL GRANT THE OWNER A REASONABLE TIME TO REQUEST THE ASSIGNMENT OF
A COMMUNITY SERVICE WORKER UNDER THIS SUBSECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.

(House Bill 444)

AN ACT concerning

Prince George's County - Courts - Compensation of Jurors Jury Compensation -

1-Day/1-Trial System

PG 333-95

FOR the purpose of reducing the per diem compensation a person receives as a juror in
Prince George's County; making the juror compensation reduction provided under
this Act subject to the contingency that a 1-day/1-trial jury system be established by
the Clerk of the Circuit Court for Prince George's County; and generally relating to
the compensation of jurors in Prince George's County and the jury system in Prince
George's County.

BY repealing and reenacting, with amendments,
