Ch. 57                                     1995 LAWS OF MARYLAND

(v) The defendant's failure to respond to the summons [is contempt
of court] SHALL RESULT IN THE ENTRY OF JUDGMENT AGAINST THE DEFENDANT IN
FAVOR OF WSSC IN THE AMOUNT THEN DUE IF A PROPER DEMAND FOR JUDGMENT
ON AFFIDAVIT HAS BEEN MADE.

(9) In any proceeding for a WSSC infraction before the District Court, the
District Court shall prosecute the violation in the same manner and to the same extent
provided for municipal infractions in Article 23A, § 3(b) [(8)] (7), (10), AND (12) through
(15), inclusive, of the Code.

18-104.2.

(f) (1) If a person who receives a citation for a WSSC infraction fails to pay the
fine by the date for payment set forth on the citation and fails to file a notice of the
person's intention to stand trial for the offense, THE PERSON IS LIABLE FOR THE
ASSESSED FINE AND the WSSC shall send a formal notice of the violation to the person's
last known address.

(2)     If the citation has not been satisfied within 35 days from the date of the
notice, the WSSC may request adjudication of the case through the District Court,
INCLUDING THE FILING OF A DEMAND FOR JUDGMENT ON AFFIDAVIT. The District
Court shall schedule the case for trial and [summon] SUMMONS the defendant to
appear.

(3)     The defendant's failure to respond to the summons [is contempt of
court] SHALL RESULT IN THE ENTRY OF JUDGMENT AGAINST THE DEFENDANT IN
FAVOR OF WSSC IN THE AMOUNT THEN DUE IF A PROPER DEMAND FOR JUDGMENT
ON AFFIDAVIT HAS BEEN MADE.

(h) In any proceeding for a WSSC infraction before the District Court, the
violation shall be prosecuted in the same manner and to the same extent provided for
municipal infractions in Article 23A, § 3(b) [(8)] (7), (10), AND (12) through (15),
inclusive, of the Code.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1995.
