PARRIS N. GLENDENING, Governor

Ch. 36

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 366.

The Insurance Article Review Committee notes, for the consideration of the
General Assembly, that subsection (b)(1) of this section refers to "personal
insurance". Elsewhere, this subtitle refers to "insurance ... on the individual's
own life or body" and "life insurance or health insurance". The General
Assembly may wish to conform these references with a standard reference to
"life insurance or health insurance". See subsection (a)(1) of this section and
§ 12-202 of this subtitle.

In subsection (b)(4)(ii)2A of this section, the reference to "at least" 12
consecutive months of employment is added for clarity.

In subsection (b)(5)(i)2 of this section, the reference to a "close" corporation
is substituted for the former reference to a "closed" corporation to conform to
the terminology used in Title 4 of the Corporations and Associations Article
and in the original enactment of this provision. See Ch. 47, Acts of 1956. The
Insurance Article Review Committee calls this substitution to the attention of
the General Assembly.

In subsection (b)(5)(ii) of this section, the former reference to "heretofore or
hereafter" is deleted as unnecessary.

In subsection (c)(2) of this section, the references to an "insurance policy" are
substituted for the former references to an "insurance contract" and
"insurance" for clarity.

In subsection (c)(3) of this section, the former reference to an insurance
policy "issued under the insurance contract" is deleted as surplusage.

In subsection (d) of this section, the word "insurance" is added to modify the
reference to a "contract" for clarity.

Defined terms: "Insurance" § 1-101
"Insurance contract" § 1-101
"Insurer" § 1-101
"Person" § 1-101
"Policy" § 1-101
"Premium" § 1-101

12-202. APPLICATION OR CONSENT REQUIRED FOR LIFE OR HEALTH INSURANCE
CONTRACTS.

(A) IN GENERAL.

(1) THIS SUBSECTION DOES NOT APPLY TO A CONTRACT OF GROUP LIFE
INSURANCE OR GROUP OR BLANKET HEALTH INSURANCE.
