(1)     A TEMPORARY CERTIFICATE OF QUALIFICATION ISSUED UNDER
SUBSECTION (A) OF THIS SECTION EXPIRES 15 MONTHS AFTER ITS EFFECTIVE DATE.

(2)     A TEMPORARY CERTIFICATE ISSUED UNDER SUBSECTION (B) OF
THIS SECTION EXPIRES NOT LATER THAN 90 DAYS AFTER ITS EFFECTIVE DATE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 172.

In subsection (a)(2)(i) of this section, the term "personal representative" is
substituted for the former terms "administrator" and "executor" to use a
gender neutral term in accordance with SG § 2-1317(7). See Art. 1, § 5 of the
Code.

In subsection (c)(1) of this section, the former reference to a "particular" kind
of insurance is deleted as surplusage.

In subsection (d)(1) of this section, the former reference to an application
"containing such information as the Commissioner may reasonably require" is
deleted as unnecessary in light of the reference to an application "on the form
that the Commissioner provides".

The Insurance Article Review Committee notes, for consideration by the
General Assembly, that in practice the Commissioner will issue a temporary
certificate of qualification to the surviving spouse of a deceased agent even
though the surviving spouse does not hold an appointment from an insurer if
the temporary certificate of qualification is used by the surviving spouse solely
to collect commissions earned by the deceased agent. (If the surviving spouse
wishes to sell insurance, the surviving spouse must obtain an appointment.) In
addition, the Commissioner will allow the temporary certificate of
qualification to remain in effect for the duration of the life of the surviving
spouse.
