1995 LAWS OF MARYLAND

(III)    AN APPLICANT FOR A CERTIFICATE OF QUALIFICATION TO
ACT AS AN AGENT FOR A NONPROFIT HEALTH SERVICE PLAN IF THE APPLICANT
FOR COMPENSATION SOLICITED, PROCURED, OR NEGOTIATED CONTRACTS FOR
NONPROFIT HEALTH SERVICE PLANS CONTINUOUSLY FROM JULY 1, 1988, TO JUNE 30,
1989; OR

(IV)    AN APPLICANT FOR A CERTIFICATE OF QUALIFICATION TO
ACT AS AN AGENT FOR A HEALTH MAINTENANCE ORGANIZATION IF THE
APPLICANT FOR COMPENSATION SOLICITED, PROCURED, OR NEGOTIATED
CONTRACTS FOR HEALTH MAINTENANCE ORGANIZATIONS CONTINUOUSLY FROM
JULY 1, 1988, TO JUNE 30, 1989.

(3) THE COMMISSIONER MAY WAIVE THE EXAMINATION
REQUIREMENT OF THIS SECTION FOR AN APPLICANT WHO:

(I)       HAS BEEN CONFERRED THE CHARTERED LIFE UNDERWRITER
(C.L.U.) DESIGNATION BY THE AMERICAN COLLEGE OF LIFE UNDERWRITERS; AND

(II)     IS A MEMBER IN GOOD STANDING OF THE AMERICAN SOCIETY
OF CHARTERED LIFE UNDERWRITERS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 168(b)(1)(ii) and (i), as it related to an
individual being of good character and trustworthy, and (c)(1)(i), as it related
to former (b)(1)(i) and (ii), § 176(b), the first sentence of § 178, and § 178(2),
(5), (6), (7), (1), as it related to passing an examination, and, except as it
related to a certificate of completion, the fifth sentence of (3).

Subsection (d)(1) of this section is rephrased in standard language to conform
to similar provisions in this article and in other revised articles of the Code.

In subsection (d)(2)(ii), (iii), and (iv) of this section, the former phrases "in
any manner" are deleted as surplusage.

Former Art. 48A, § 178(4), which exempts certain employees of health
maintenance organizations from the examination requirement, is deleted as
unnecessary in light of § 10-125 of this subtitle.

10-106. QUALIFICATIONS OF PARTNERSHIP OR CORPORATION APPLICANTS.

TO QUALIFY FOR A CERTIFICATE OF QUALIFICATION AS AN AGENT OR
BROKER, A PARTNERSHIP OR CORPORATION MUST BE PRIMARILY ENGAGED IN THE
INSURANCE BUSINESS.
