Ch. 36

1995 LAWS OF MARYLAND

(2)     THE COMMISSIONER MAY APPROVE ANY FORM THAT CONTAINS
PROVISIONS THAT ARE MORE FAVORABLE TO THE MEMBERS OF THE SOCIETY THAN
THE REQUIRED PROVISIONS OF THE COMMISSIONER.

(3)      UNLESS DISAPPROVED BY THE COMMISSIONER, A FORM IS DEEMED
APPROVED 60 DAYS AFTER THE DATE THE FORM IS FILED WITH THE
COMMISSIONER.

.(C) REGULATIONS.

(1)     THE COMMISSIONER MAY ADOPT REASONABLE REGULATIONS
THAT PRESCRIBE THE REQUIRED, OPTIONAL, AND PROHIBITED PROVISIONS TO BE
INCLUDED IN CONTRACTS OF HEALTH INSURANCE OR TOTAL AND PERMANENT
DISABILITY INSURANCE.

(2)     TO THE EXTENT PRACTICABLE, THE REGULATIONS SHALL
CONFORM TO THE REQUIREMENTS OF TITLE XX [ART. 48A, SUBTITLE 25] OF THIS
ARTICLE.

(3)      IF THE COMMISSIONER DETERMINES THAT ALL OR PART OF THE
REQUIREMENTS OF TITLE XX [ART. 48A, SUBTITLE 25] OF THIS ARTICLE ARE
INAPPLICABLE, THE COMMISSIONER MAY PRESCRIBE THE PARTS OR SUMMARY OF
THE PARTS OF THE CONTRACT TO BE PRINTED ON THE CERTIFICATE THAT IS
ISSUED TO THE MEMBER.

REVISOR'S NOTE: This section is derived without substantive change from
former Art. 48A, § 334.

In the introductory language of subsection (a) of this section, the former
reference to a "domestic, foreign, or alien" society is deleted as superfluous
because the general reference to a "society" encompasses all the specific types
of societies.

Also in the introductory language of subsection (a) of this section, the former
word "until" is deleted as redundant in view of the use of the word "unless".

In subsections (a)(1) and (c)(1) of this section, the former phrases "from time
to time" are deleted as surplusage.

In subsection (a)(2) of this section, the former reference to "reasonable"
regulations of the Commissioner is deleted as unnecessary in light of
subsection (c)(1) of this section.

Also in subsection (a)(2) of this section, the former reference to "rules" is
deleted as unnecessary in light of the reference to "regulations". See the
General Revisor's Note to this article.

In subsection (b)(2) of this section, the former reference to the
Commissioner's "opinion" is deleted as implicit in the authority to approve or
disapprove forms.
