Ch. 36

1995 LAWS OF MARYLAND

(I)      A FELONY;

(II)     A MISDEMEANOR INVOLVING MORAL TURPITUDE;

(III)   A VIOLATION OF THIS SUBTITLE;

(IV)    AN ATTEMPT OR CONSPIRACY TO COMMIT ANY OF THE
VIOLATIONS LISTED IN SUBITEMS (I) THROUGH (III) OF THIS ITEM; OR

(V)     A CRIME IN WHICH ANY OTHER VIOLATION LISTED IN THIS
ITEM IS AN ELEMENT;

(2)      HAS OBTAINED THE BOND REQUIRED BY § 8-306 OF THIS SUBTITLE
OR HAS QUALIFIED FOR ONE OF THE APPLICABLE. EXEMPTIONS FROM THE
BONDING REQUIREMENT;

(3)      HAS MET ANY APPLICABLE EXAMINATION REQUIREMENTS
ADOPTED BY THE COMMISSIONER UNDER SUBSECTION (B) OF THIS SECTION; AND

(4)      FOR THE ADMINISTRATION OF HEALTH BENEFIT PLANS IN THE
STATE, USES ONLY THE UNIFORM CLAIM FORMS ADOPTED BY THE COMMISSIONER
UNDER § XX-XXX OF THIS ARTICLE [48A § 490P].

(B) TESTING PROCEDURES.

(1)      THE COMMISSIONER MAY DEVELOP APPROPRIATE TESTING
PROCEDURES TO MEASURE AN APPLICANT'S FAMILIARITY WITH THIS SUBTITLE.

(2)      TO DEVELOP TESTING PROCEDURES, THE COMMISSIONER SHALL
CONSULT WITH REPRESENTATIVES OF ADMINISTRATORS, EMPLOYEE
ORGANIZATIONS, AND EMPLOYERS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, §§ 683, 689(b)(1) and (2), and, except as it
related to renewal of an application, § 684(a).

Former Art. 48A, § 689(b)(3), which provided that the testing procedures
adopted under subsection (b) of this section apply only to applicants whose
initial registration is on or after January 1, 1994, is transferred to the Session
Laws since it is now of limited application.

8-305. APPLICATIONS FOR REGISTRATION.

AN APPLICANT FOR REGISTRATION SHALL:

(1)      FILE WITH THE COMMISSIONER AN APPLICATION ON THE FORM
THAT THE COMMISSIONER REQUIRES; AND

(2)      PAY TO THE COMMISSIONER AN APPLICATION FEE OF $250.
