2 And said Enrolment having certified that the said ship Seal or vessel has one Deck and two Masts and that her length is of the sixty three feet six inches her breadth twenty feet Eleven Collector inches her depth six feet two inches and that she was of the sixty nine 13/95 tons that she is a schooner has a square stern Port of and no figure head Vienna And the said William Blades having agreed to the description and measurement above specified according to the Seal said act the said schooner has been duly Enrolled at of the the port of Vienna Given under my hand and Naval Officer seal at the port of Vienna this thirteenth day of of the March in the year one thousand eight Hundred Port of and forty To have and to hold the said schooner or vessel and the appurtenances thereunto belonging unto the said James Graham and Robert Graham their executors administrators and assigns to the only proper use and behoof and as the proper goods and chattles of the said James Graham and Robert Graham their executors administrators and assigns from henceforth forever and I the said Edward Mezick for my self my Executors and administrators do hereby covenant and agree to and with the said James Graham and Robert Graham their executors administrators and assigns that at the Execution of these presents I am the true and lawfull owner of the said schooner or vessel called the Fidelity of Vienna and appurtenances and I have full right and authority to sell and dispose of the same freed form and cleared of all claims incumbrances or demands whatsoever Provided always and these presents are upon this condition Nevertheless that if the said Edward Messick his executors or administrators shall well and truly pay or cause to be paid unto the said James & Robert Graham their executors administrators or assigns the sum of three hundred and ten dollars and the legal interest in the same at the time limited in the said promissory note for the payment thereof that then and from thence forth these presents and every thing herein contained shall cease and determine and be absolutely void otherwise to be and remain in full force and virtue. And it is hereby covenanted and agreed by and between the parties to these presents that if default shall be made in the payment of the said sum of three hundred and ten dollars owing as aforesaid on the said |
