in the budget and the amount to be withheld to be paid. The committee shall consider the
recommendations of the Governor and advise the Governor as to its decision whether or
not to allow the salary to be restored to the full amount as provided in the budget and the
amount withheld to be paid,

SECTION 22. AND BE IT FURTHER ENACTED, That:

(1)     For Fiscal Year 1995, the Secretary of the Department of Budget and Fiscal
Planning shall withhold allotment to the agencies of funds appropriated in this budget for
insurance coverage (Subobjects W02 or G04) to reflect a maximum State tort liability of
$60,000 to a single claimant for injuries arising from a single incident or occurrence; as
provided in Section 9;

(2)     Funds withheld under this section shall revert to the fund from which they
were appropriated at the end of the fiscal year unless they are reduced from the budget
under Section 7-213 of the State Finance and Procurement Article;

(3)     The Secretary shall take such action as is required to assure reduction or
reversion of at least $560,000 $640,000 in general funds and $320,000 $360,000 in special
or current unrestricted funds.

SECTION 23. AND BE IT FURTHER ENACTED, That the Department of
Budget and Fiscal Planing shall prepare a report for the review of the budget committees
any time it changes the unemployment surcharge rate on State agencies including any
change from the rate upon which the budget was prepared. This report must contain
projections of income, expenditures, and program balance supporting the change.

SECTION 24. AND BE IT FURTHER ENACTED, That:

(1)     Amounts of appropriations made in Section 1 of this Act that are made
contingent on enactment of a tobacco tax shall be reduced from the budget; and

(2)     Any language attached to the budget bill making amounts of appropriations
contingent on enactment of a tobacco tax shall be without force or effect.

SECTION 25. AND BE IT FURTHER ENACTED, That:

(1)     For Fiscal Year 1995, the Secretary of Budget and Fiscal Planning shall
withhold allotment to allocate reductions to the agencies of funds appropriated in this
budget for contractual employee salaries (Subobjects A02 and B20) and fringe benefits
(Subobjects B13 and B14), excluding amounts for contractual teaching faculty, work
study, and research, auxiliary and hospital programs in public institutions of higher
education, in order to establish a turnover expectancy factor of 5 percent for contractual
positions;

(2)     Funds withheld under this section shall revert as provided by law at the end of
the fiscal year unless they are reduced from the budget under Section 7-213 of the State
Finance and Procurement Article; and
