Airport as reported to the General
Assembly during the 1994 session, and the
proposal to finance the international
terminal expansion through the Maryland
Transportation Authority, the department
shall provide notification to the budget
committees without the need for further
action on the part of the General Assembly.
Except as provided in this section, the
Department of Transportation may not
expend any funds, nor is it the intent that
the Maryland Transportation Authority
advance funds, toward the construction of
an international terminal expansion at the
Baltimore Washington International
Airport beyond the design phase authorized
in the FY 1994 budget if the Federal
Aviation Administration (FAA);
(1) Does not approve construction of the
international terminal expansion;
(2) Does not approve the proposed financing
mechanism using the Maryland
Transportation Authority; or,
(3) Provides modified approval for any part
of the project which increases the cost in
excess of $140.3 million (5% of the $133.6
million estimate reviewed by the General
Assembly during the 1994 session).
The department shall notify the budget
committees of any component of the
proposal which was modified by the FAA or
which did not receive FAA approval. In
addition, the department will report on any
alternative plans to construct and finance
the international terminal expansion at the
Baltimore Washington International
Airport. Implementation of any alternatives
which increases the cost in excess of $140.3
million may not occur until a report is
received by the budget committees and the
committees have reviewed and commented
upon it or up to 45 days have passed from
the date of receipt.
