[39.] 11.

The extended coverage of State and local public employees under the federal old
age and [survivors] SURVIVORS' insurance system as provided for in this [subtitle]
SUBHEADING is declared to be retroactive to January 1, 1955, if the specific plan which
is formulated in any instance for the extension of coverage so provides.

REVISOR'S NOTE: This section formerly was Art. 89, § 39.

Former Art. 89, § 39 is not retained in the Code because it is apparently
obsolete. However, it is transferred to the Session Laws to avoid any
inadvertent substantive effect that its repeal might have.

The only changes are in style.

[40.] 12.

For the purposes of referendum and of effecting the coverage of federal old age and
[survivors] SURVIVORS' insurance, the State of Maryland is declared to have the option
of treating the State Employees' Retirement System as if it were divided into separate
retirement systems, one being applicable to employees of the State of Maryland and the
other or others being applicable to the employees of any political subdivision who may
have been enrolled as members of the State Employees' Retirement System. Also, with
respect to the Teachers' Retirement System, the State of Maryland is declared to have the
option of treating any institution of higher learning having teachers or other members as
members of the Teachers' Retirement System as if that institution of higher learning had
a separate retirement system.

The only changes are in style.

SECTION 12. AND BE IT FURTHER ENACTED, That the Revisor's Notes and
catchlines contained in this Act are not law and may not be considered to have been
enacted as a part of this Act.

SECTION 13. AND BE IT FURTHER ENACTED, That nothing in this Act
affects the term of office of an appointed or elected member of any department, board,
commission, committee, agency, or other unit. An individual who is a member of a unit on
the effective date of this Act shall remain a member for the balance of the term to which
appointed or elected, unless the member sooner dies, resigns, or is removed under
provisions of law.

SECTION 14. AND BE IT FURTHER ENACTED, That, except as expressly
provided to the contrary in this Act, any transaction or employment status affected by or
flowing from any change of nomenclature or any statute amended, repealed, or
transferred by this Act and validly entered into or existing before the effective date of this
Act and every right, duty, or interest flowing from the statute, remains valid after the
